2009 Online Sweepstakes: Official Rules and Regulations

1. No purchase necessary to enter or win this sweepstakes. To enter, visit www.linvilla.com each week, starting Wednesday, November 11, 2009, and ending Friday, January 1, 2010, to answer trivia questions pertaining to Linvilla Orchards. New questions will be posted every Wednesday and Saturday. Each correct answers will qualify you to be entered into a prize drawing. Entry must include a valid name, e-mail address and zip code.

2. Prizes: Odds of winning any prize depend upon the total number of eligible entries received. Limit one prize per household. Some restrictions and black out dates may apply to prizes. Al prizes must be redeemed by date stated on prize certificate. All prizes must be redeemed in 2010.

3. Eligibility: The sweepstakes is open to legal residents of the United States 18 or older with a valid e-mail address. Not eligible are owners, employees and immediate families (spouses and parents, siblings and children and their spouses) of Linvilla Orchards Inc., their respective affiliates or subsidiaries, promotion and advertising agencies, and any other company involved with the design, production or execution of the promotion.

4. General. Winners will be selected in a random drawing conducted every Wednesday at noon and will be notified by e-mail on or about that same day.

(a) The prize winner must claim the prize by responding to the prize notification e-mail with the information requested, which is necessary to validate eligibility and deliver the prize. Failure to claim the prize within five days of prize notification will result in the prize being forfeited by the winner. Sponsor is not responsible for lost, misdirected or stolen mail, or unsafe arrival of a prize. Sponsor is not responsible for entries that are altered, defective, delayed, deleted, destroyed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, invalid, late, lost, misrouted, non-delivered, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; on-line traffic congestion; garbled or jumbled transmission; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant's e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of Sponsor or its agents (collectively "Invalid Entries"). All Invalid Entries will be disqualified.

(b) In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the e-mail address is registered. E-mail addresses collected through this contest will not be shared with 3rd parties except to the extent necessary to distribute the prizes and Linvilla Orchards news. By participating, entrants agree to be bound by these rules and the decisions of the judges, which are final in all matters relating to the Sweepstakes.

(c) By accepting the prize, winner acknowledges that he/she is eligible to claim a prize and consents to the use of his/her name and/or likeness for advertising/trade purposes without further compensation, unless prohibited by law.

(d) All federal, state and local laws and regulations apply. Sweepstakes void where prohibited by law.

(e) Any tax liability is the responsibility of the winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. Winner, by acceptance of prize, agrees to release Linvilla Orchards, Inc., its affiliate companies, subsidiaries, and agencies from any and all liabilities for injuries, damages or losses of any kind to persons or properties which may be sustained in connection with the prize or any prize-related activity. As a condition of entering, participant agrees that all disputes arising out of this promotion shall be resolved without resort to litigation.

(f) Prizes are not exchangeable or transferable and cannot be redeemed for cash. In the event of unavailability of stated prize, Sponsor reserves the right to substitute a prize of equal or greater value.
